Eatpol Food Tester Terms and Conditions

1. Acceptance of Terms
By registering as a food tester with Eatpol.com (“Eatpol,” “we,” “us,” or “our”), you (“Tester,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not register or participate in our testing services.
2. Service Description
Eatpol operates as an intermediary platform connecting food companies with consumers for product testing purposes. We facilitate:
- Distribution of food samples from third-party companies to testers
- Collection of consumer feedback and reactions
- Compensation processing for completed tests
- AI-powered analysis of tester responses
Important: Eatpol acts solely as a facilitator and intermediary. We do not manufacture, prepare, or control the food products being tested.
3. Tester Responsibilities
3.1 Eligibility
- Tester must be 18 years or older
- Must have access to a smartphone with camera and internet connection
- Must be able to consume food products (dietary restrictions can be noted during registration)
3.2 Testing Process
- Follow all provided instructions for food preparation and consumption
- Record yourself consuming the product as directed
- Provide honest, accurate feedback via audio, video, or questionnaires
- Complete tests within specified timeframes
- Maintain confidentiality of unreleased products
3.3 Health and Safety
- You are solely responsible for your own health and safety
- Review all ingredient lists and allergen information before consumption
- Do not consume products if you have known allergies or medical conditions that could be affected
- Discontinue consumption immediately if you experience adverse reactions
- Seek medical attention if needed and notify Eatpol of any incidents
4. Limitation of Liability and Disclaimers
4.1 No Liability for Food Products
EATPOL DISCLAIMS ALL LIABILITY FOR FOOD PRODUCTS PROVIDED BY THIRD-PARTY COMPANIES. We do not:
- Manufacture, prepare, or inspect the food products
- Guarantee the safety, quality, or suitability of any food product
- Assume responsibility for allergic reactions, foodborne illness, or other health issues
- Warrant that food products comply with dietary restrictions or preferences
4.2 Third-Party Responsibility
Food companies are solely responsible for:
- Product safety and quality control
- Accurate ingredient and allergen labeling
- Compliance with food safety regulations
- Any damages or injuries resulting from their products
4.3 Assumption of Risk
BY PARTICIPATING, YOU ACKNOWLEDGE AND ASSUME ALL RISKS associated with consuming food products, including but not limited to allergic reactions, foodborne illness, contamination, undisclosed ingredients, and product defects.
4.4 Limitation of Damages
To the maximum extent permitted by law, Eatpol’s total liability shall not exceed the compensation paid to you for the specific test in question.
5. Compensation
- Compensation ranges from €10–€15 per completed test
- Payment processed within 30 days of test completion
- Compensation is forfeited if test requirements are not met (test requirements will be provided per each test)
6. Privacy and Data Protection
- Personal data is processed according to GDPR regulations
- Videos are securely stored and not shared outside Eatpol
- Tester identity is anonymized in all analyses
7. Intellectual Property
- Feedback and reactions become the property of the requesting food company
- Eatpol retains rights to aggregated, anonymized data
- Testers grant a non-exclusive license to use their feedback for intended purposes
8. Termination
- Either party may terminate this Agreement at any time
- Eatpol may remove testers for violations or safety concerns
- Testers may withdraw by contacting customer service at info@eatpol.com
- Outstanding compensation for completed tests remains payable
9. Indemnification
You agree to indemnify and hold harmless Eatpol, its officers, directors, employees, and agents from any claims, damages, or expenses arising from: your participation in food testing; your violation of these terms; your consumption of food products; or any false or misleading information you provide.
10. Dispute Resolution
- These Terms are governed by Dutch law
- Disputes will be resolved through the competent Dutch court
- Class action lawsuits are waived where legally permissible
11. General Provisions
11.1 Severability
If any provision is deemed unenforceable, the remaining provisions continue in full force.
11.2 Modifications
Eatpol may update these Terms with 30 days’ notice. Continued participation constitutes acceptance.
11.3 Force Majeure
Neither party is liable for delays due to circumstances beyond reasonable control.
11.4 Entire Agreement
This Agreement constitutes the complete understanding between the parties.
